Which terms apply to you
The table below sets out the agreements that apply when you use Streetfast. Each is a separate agreement with Streetfast Inc. By ticking the acceptance box, creating an account, or using or placing a request through a Streetfast-branded app or website, you confirm that you accept the applicable terms.
| Terms | Streetfast party | When do they apply to you? |
|---|---|---|
| General Terms of Use (this document) | Streetfast Inc. (“Streetfast”) | Every time you access or use any Streetfast platform, app, website, content, product or service — including Bike, Auto and Car rides, Wait & Save, Scheduled rides, Flex Fare, Parcel delivery, Store orders and Family accounts. |
| Privacy Policy | Streetfast Inc. | Whenever we collect, use or share your personal information in connection with the Services. |
| Captain Partner Agreement | Streetfast Inc. | Only if you register as a Captain (driver or courier). It applies in addition to these Terms. |
| Store Partner Agreement | Streetfast Inc. | Only if you register a business as a Store Partner (merchant) to sell through the platform. Signed by an authorised signatory in the Store Partner panel. |
Please read these terms carefully before accessing or using the Streetfast Services
They include a mandatory arbitration requirement (section 7) and limits on Streetfast’s liability (section 5). Nothing in these Terms removes consumer rights that cannot be excluded under the law of your province.
1.Contractual relationship
These Streetfast Inc. — Terms and Conditions — Canada (the “Streetfast Terms” or “Terms”) govern the access to or use by you, an individual, of any platform, application, website, content, product or service (together, the “Streetfast Services” or “Services”) made available in Canada by Streetfast Inc., a corporation incorporated under the laws of Alberta (“Streetfast”).
Scope of these Terms
The Streetfast Services are a technology platform. They do not include any transportation, delivery or retail service. Rides, parcel deliveries and the goods you order are provided by independent Captains and Store Partners (together, “Third Party Providers”) who have their own agreement with Streetfast. Streetfast may provide parts of the Services through affiliates where these Terms or supplemental terms say so.
Acceptance
You accept these Terms by ticking a box, by creating an account, by using or placing a request through a Streetfast-branded app or website, or by otherwise indicating your acceptance. By continuing to access or use the Services you agree to be bound by these Terms as amended from time to time, and a contract is formed between you and Streetfast. If at any time you do not agree to these Terms, you must stop accessing and using the Services. These Terms replace any earlier agreement or arrangement between you and Streetfast about the Services. Streetfast may end these Terms or any Service as it applies to you, or stop offering or refuse access to all or part of the Services, at any time and for any reason permitted by law.
Supplemental terms
Supplemental terms may apply to particular Services — for example rules for a promotion, an event, a city, or a category of Service such as Parcel delivery, Family accounts or Streetfast for Business. Supplemental terms are shown to you in connection with the relevant Service. You also agree to follow the Streetfast Community Guidelines published in the app. Supplemental terms and policies, including the Community Guidelines, are in addition to and form part of these Terms for the relevant Service, and prevail over these Terms if there is a conflict about that Service. The Partner Agreement is not a supplemental term; it is a separate agreement between Streetfast and Third Party Providers.
Amendments
Streetfast may amend these Terms and any supplemental terms or policies from time to time. If a change is material and detrimentally affects your rights, we will give you notice by email, by a notice in the Services, or by updating the “Last updated” date above; where the change is material we will give at least 30 days’ notice before it takes effect. Otherwise amendments take effect when the updated Terms are posted here. Your continued access to or use of the Services after notice or posting constitutes acceptance of the amended Terms. If you do not agree to an amendment you must stop using the Services.
Privacy
Our collection and use of personal information in connection with the Services is described in the Streetfast Privacy Policy. You consent to Streetfast providing an insurer or insurance claims processor with the information reasonably necessary (including your contact details and trip records) to resolve a complaint, dispute or conflict — including an accident — involving you and a Third Party Provider.
2.The Streetfast Services
Streetfast will provide the Services to you in accordance with these Terms. The Services are a technology platform that lets you, as a user of Streetfast’s apps or websites (each an “Application”): (a) arrange and schedule services with Third Party Providers, namely (i) transportation by bike, auto or car from Captains, (ii) same-day parcel delivery by Captains, and (iii) the purchase of food, grocery and retail items from Store Partners and their delivery by Captains; (b) pay Third Party Providers for those goods and services and receive receipts for those payments; and (c) access related content and services, including customer support.
The Services are made available solely for your personal, non-commercial use unless Streetfast has agreed otherwise with you in a separate agreement (such as Streetfast for Business). You acknowledge that: (a) Streetfast does not provide transportation services and is not a transportation carrier; (b) all transportation is provided by Captains, who are independent contractors and not employees of Streetfast; (c) Streetfast does not provide delivery services or sell the items listed by Store Partners; and (d) Third Party Providers are solely responsible for the services and goods they provide to you.
Licence
Subject to your compliance with these Terms, Streetfast grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to: (i) access and use the Applications on a personal device you own or control, solely in connection with your use of the Services; and (ii) access and use any content, information and related materials made available through the Services, in each case solely for your personal, non-commercial use. All rights not expressly granted are reserved by Streetfast and its licensors.
Restrictions
You may not: (i) remove any copyright, trademark or other proprietary notice from any part of the Services; (ii) reproduce, modify, create derivative works from, distribute, license, lease, sell, resell, transfer, publicly display or perform, transmit, stream, broadcast or otherwise exploit the Services except as Streetfast expressly permits; (iii) decompile, reverse engineer or disassemble the Services except as applicable law permits; (iv) link to, mirror or frame any part of the Services; (v) run programs or scripts to scrape, index, survey or otherwise mine any part of the Services, or unduly burden or hinder their operation; or (vi) attempt to gain unauthorised access to or impair any part of the Services or their related systems or networks.
Provision of the Services
Parts of the Services are made available under Streetfast’s brands and request options for transportation, delivery and store ordering, currently including “Streetfast Bike”, “Streetfast Auto”, “Streetfast Car”, “Wait & Save”, “Schedule”, “Flex Fare”, “Street Hours”, “Streetfast Parcel”, “Streetfast Stores”, “Streetfast Teen” and “Streetfast Senior”. Each option is fulfilled by Third Party Providers. Some options carry their own supplemental terms shown in the app — for example: Wait & Save offers a discounted fare in return for a longer pickup window, which is a maximum rather than a guaranteed pickup time; Flex Fare lets you propose a fare within a permitted range that a Captain may accept or decline, and no ride is booked until a Captain accepts; Schedule starts matching before your chosen window but a Captain is not guaranteed until one has accepted.
Third-party services and content
The Services may be made available or accessed together with third-party services and content that Streetfast does not control — including map and address data, sign-in providers and payment processors. Different terms of use and privacy policies may apply to those services and content. Streetfast does not endorse them and is not responsible or liable for the products or services of such third parties.
App stores
Availability of the Applications may depend on the third-party store from which you downloaded them, such as the Apple App Store or Google Play (each an “App Store”). These Terms are between you and Streetfast, not the App Store, and Streetfast is responsible for providing the Services as described here. However, if you access the Services through an Application built for Apple iOS or Google Android, Apple Inc. and Google LLC (and their applicable affiliates) are third-party beneficiaries of these Terms and, on your acceptance, have the right to enforce them against you. Any terms of the relevant App Store — including Apple’s Licensed Application End User Licence Agreement, under which you are the “end-user” — are incorporated by reference; if they conflict with these Terms, these Terms control.
Ownership
The Services and all rights in them are and remain the property of Streetfast or its licensors. Neither these Terms nor your use of the Services grants you any right: (i) in or related to the Services other than the limited licence above; or (ii) to use or refer to Streetfast’s company name, logos, product and service names, trademarks or service marks, or those of its licensors, in any manner.
Streetfast Active Area
The goods and services you can request through the Services are available only in designated areas communicated through the Application from time to time (the “Streetfast Active Area” — currently service zones in Alberta). Requests can be started only from within an Active Area. Streetfast does not guarantee that you will be able to request any particular good or service within an Active Area at all times, or that every ride option or Service is offered in every Active Area.
3.Your use of the Services
User accounts
To use most aspects of the Services you must register for and maintain an active personal user account (“Account”). You must be at least 18 years old, or the age of majority in your province if higher, to hold an Account, unless a specific Service (such as a Family account) permits otherwise. Registration requires you to give Streetfast certain personal information — such as your name, mobile phone number, email address and age — and at least one valid payment method (a credit or debit card, an accepted payment partner, or your Streetfast wallet; cash may be enabled in some cities). You agree to keep your Account information accurate, complete and up to date. Failure to do so, including keeping an invalid or expired payment method on file, may prevent you from accessing or using the Services. You are responsible for all activity under your Account and agree to keep your login credentials and one-time codes secure at all times. Unless Streetfast permits otherwise in writing, you may hold only one Account.
User requirements and conduct
General. The Services are not available to persons under 18 except as managed members of a Family account (below). You may not authorise third parties to use your Account, and you may not allow a person under 18 to receive (i) transportation from a Captain unless they are accompanied by you, or (ii) delivery services, and you accept full responsibility for the acts and omissions of any minor you allow to use the Services. You may not assign or transfer your Account to anyone else. You agree to comply with all applicable laws when using the Services and to use them only for lawful purposes — for example, no transport or dispatch of unlawful, dangerous or hazardous materials — and in accordance with these Terms. You will not, in your use of the Services, cause nuisance, annoyance, inconvenience or property damage to a Third Party Provider or anyone else, including Streetfast, its affiliates and their employees, agents or contractors. In some cases you may be asked to provide proof of age or identity to access the Services or to receive an age-restricted item, and you agree that access or delivery may be refused if you decline.
Family accounts (Teen and Senior). Where offered, an adult Account holder (the “Organiser”) may add a teen aged 13–17 or a senior as a managed member. The Organiser must be the parent, legal guardian or authorised caregiver of the member and must have their consent (or give it on a minor’s behalf). The Organiser is responsible for all activity and charges on managed profiles, receives live trip updates, may set ride limits, and agrees to ensure the member follows these Terms. Teen rides are offered only to Captains who meet additional requirements and must be verified with a PIN at pickup.
Parcels. If you send a parcel you remain responsible for its contents and for having the right to send them. You must accurately declare the size and type of item. You may not send cash, cheques or securities; alcohol, cannabis or tobacco (other than from a licensed Store Partner where the law allows); firearms, weapons or ammunition; illegal drugs; live animals; hazardous, flammable or explosive goods; perishable goods without suitable packaging; stolen goods; or anything illegal to possess, ship or deliver. Captains may refuse a parcel that appears to breach this list or exceeds the declared size. You must give accurate recipient details and be available (or arrange someone to be available) at pickup.
Car seats. If you travel with a child for whom a child restraint is legally required, you are responsible for providing an appropriate car seat, installing it correctly and securing the child. Neither Streetfast nor the Captain is responsible for the safety of a child restraint you bring or that may be available in the vehicle.
Pets and service animals. Subject to the Captain’s discretion, you may bring a small animal on a ride if it is properly secured with a leash, harness or carrier. You are responsible for any damage or mess the animal causes and may be charged under section 4 (Repair, Cleaning or Other Fees). Service animals accompanying a rider with a disability are permitted at no extra charge in accordance with applicable accessibility law.
Commercial electronic messaging
By creating an Account you agree that Streetfast and its affiliates may send you electronic messages — email, SMS and push notifications — as part of the normal operation of the Services (trip confirmations, one-time codes, receipts, safety alerts) and, with your consent as required by Canada’s Anti-Spam Legislation, marketing and promotional messages about Streetfast’s Applications, products and services. You may withdraw consent to marketing messages at any time in Account → Notifications or by following the unsubscribe instructions in a message. Where an unsubscribe mechanism is impractical (for example in a push notification), use the Account settings instead. Opting out of some electronic messages may affect your use of the Services. Standard message and data rates may apply.
Promotional codes
Streetfast may, at its discretion, create promotional codes redeemable for Account or wallet credit, discounts or other features or benefits related to a Third Party Provider’s services, subject to additional terms set for each code (“Promo Codes”). You agree that Promo Codes: (i) must be used by the intended audience, for the intended purpose and lawfully; (ii) may not be duplicated, sold, transferred or made available to the general public unless Streetfast expressly permits; (iii) may be disabled by Streetfast at any time, as permitted by law, without liability; (iv) may be used only under the specific terms set for that code; (v) have no cash value; and (vi) may expire before you use them. Streetfast may withhold or deduct credit or other benefits obtained through a Promo Code — by you or any other user — where it reasonably determines that its use or redemption was in error, fraudulent, illegal or in breach of the code’s terms or these Terms.
User-provided content
Streetfast may, at its discretion, let you submit, upload, publish or otherwise make available text, audio or visual content and information through the Services — including ratings, feedback, chat messages, support requests and entries to promotions (“User Content”). User Content you provide remains your property. By providing it you grant Streetfast and its affiliates a worldwide, perpetual, irrevocable, transferable, royalty-free licence, with the right to sublicense, to use, copy, modify, create derivative works from, distribute, publicly display and perform, and otherwise exploit that User Content in any format and channel now known or later developed (including in connection with the Services and Streetfast’s business and on third-party sites), without further notice, consent or payment.
You represent and warrant that: (i) you own all User Content or have the rights, licences, consents and releases needed to grant the licence above; and (ii) neither the User Content nor your provision of it, nor Streetfast’s use of it as permitted here, will infringe or misappropriate any third party’s intellectual property, proprietary, publicity or privacy rights, or breach any law.
You agree not to provide User Content that is defamatory, libellous, hateful, violent, obscene, pornographic, unlawful or otherwise offensive, as determined by Streetfast in its sole discretion, whether or not such material is protected by law. Streetfast may, but is not obliged to, review, monitor or remove User Content at any time, for any reason, without notice.
Network access and devices
You are responsible for obtaining the data network access needed to use the Services. Your mobile network’s data and messaging rates may apply when you use the Services from a wireless device and you are responsible for those charges. You are responsible for acquiring and updating compatible hardware and devices needed to access the Services and Applications and any updates to them. Streetfast does not guarantee that the Services, or any part of them, will function on any particular device, and the Services may be subject to malfunctions and delays inherent in the use of the internet and electronic communications.
4.Payment
Use of the Services may result in charges to you for the services or goods you receive from a Third Party Provider (“Third Party Charges”). After you receive services or goods through the Services, Streetfast facilitates your payment of the applicable Third Party Charges as the Third Party Provider’s limited payment collection agent. Payment made in this way is treated as payment made directly by you to the Third Party Provider. Third Party Charges include applicable taxes where the law requires. Third Party Charges you pay are final and non-refundable unless Streetfast determines otherwise or applicable consumer law requires a refund. Subject to local regulations, you may ask a Captain to increase or lower a Third Party Charge for transportation services you received, and Streetfast will act on any resulting request from the Captain to modify that charge.
All Third Party Charges are due immediately and are collected by Streetfast using the preferred payment method on your Account, after which you will receive a receipt. If your primary payment method is expired, invalid or otherwise cannot be charged, you agree that Streetfast may, on the Third Party Provider’s behalf, use a secondary payment method on your Account, including your Streetfast wallet, if available. Where cash is enabled in your city and you choose it, you pay the Captain directly at the end of the ride or on delivery; if you cannot pay in cash, the amount may be charged to another payment method on your Account or held as an outstanding balance until settled.
Streetfast shows you the price before you confirm a request. You acknowledge that Streetfast may establish or adjust Third Party Charges for any services or goods obtained through the Services at any time at the direction of the Third Party Provider or otherwise at its reasonable discretion — including where you choose an additional service that incurs an additional charge, change the destination, add stops or incur waiting time. You further acknowledge that Third Party Charges in a given area may increase during periods of high demand through a flat, policy-capped busy-area fee, which is shown in the fare breakdown before you confirm. Streetfast uses reasonable efforts to inform you of Third Party Charges that may apply, but you are responsible for all charges incurred under your Account. A charge from Streetfast on your card statement does not necessarily mean Streetfast sold you an item or service; it means Streetfast facilitated payment, and the Third Party Provider named on your receipt is the actual seller.
Streetfast may from time to time give certain users Promo Codes that result in different amounts being charged for the same or similar services or goods. Such Promo Codes are provided for no fee, have no monetary value, cannot be redeemed for cash and are not exchangeable or transferable; unless also made available to you, they have no bearing on your use of the Services or the Third Party Charges applied to you.
Gratuities
The payment structure is intended to fully compensate the Third Party Provider for the services or goods provided. Streetfast does not designate any part of your payment as a tip or gratuity. You are free to give an additional amount as a gratuity to a Captain who provides you with services, and 100% of any tip added in the app is passed to the Captain, but you are under no obligation to do so. Gratuities are voluntary. After receiving services or goods you will have the opportunity to rate your experience and leave feedback about the Third Party Provider.
Cancellations
You may cancel a request for transportation at any time before the Captain arrives; if you cancel after the free-cancellation window shown in the app (typically two minutes after a Captain is matched), or if the Captain arrives and waits beyond the free waiting time without being able to reach you, you may be charged a cancellation fee published for your city. If transportation is cancelled for a reason not attributable to you under Streetfast’s cancellation policy — for example the Captain cancels, arrives materially later than the ETA shown at booking, or arrives in a vehicle that does not match the one shown — you may be entitled to a refund of any charges paid.
If you purchase items from a Store Partner, you may cancel your order at any time until the Store Partner has begun preparing it. Once preparation has begun you can no longer cancel without incurring a charge, which will be no more than the full price of the ordered items. If you cancel after delivery has begun, you will also be charged the full price of the delivery services.
If a parcel delivery or store delivery fails or is cancelled for reasons that Streetfast, acting reasonably, determines are attributable to you — for example an incorrect address, an unreachable recipient, or an item that does not match its declaration — you will be charged no more than the full price of the items and delivery services, and a return fee may apply where the Captain returns a parcel to the pickup address. If a delivery fails or is cancelled for a reason not attributable to you, you may be entitled to a refund of the charges paid for that delivery. Scheduled rides may be cancelled free until the pickup window opens.
If you require a correction to any Third Party Charge, you must notify Streetfast in writing (through in-app support) within 30 days after the charge was invoiced. After that period Streetfast has no further responsibility for the charge and you waive any right to dispute it later. Approved refunds are returned to the original payment method or, at your choice, credited to your Streetfast wallet.
Repair, cleaning or other fees
Streetfast may charge you a fee if, during your use of the Services, you cause damage to a Third Party Provider’s vehicle or property that requires repair or cleaning (“Repair” or “Cleaning”). The amount is determined by Streetfast at its reasonable discretion based on the type and severity of the damage. Streetfast may require verification or documentation of the damage before processing a fee. Where a Captain reports the need for Repair or Cleaning and Streetfast verifies the request at its reasonable discretion, Streetfast may facilitate payment of the reasonable cost of the Repair or Cleaning on the Captain’s behalf using the payment method on your Account, show you the charge and supporting evidence in your trip history, and transfer the amount to the Captain. Such amounts are non-refundable. A return fee may also apply where a Captain returns an item you left in a vehicle.
In addition, if you fail to comply with these Terms you may be responsible for additional fees or charges, including for transactions that could not be completed properly as a result of your non-compliance.
5.Disclaimers; limitation of liability; indemnity
Application to Streetfast and its affiliates
The limitations and disclaimer in this section 5 apply to the liability of Streetfast and its affiliates under these Terms, including in relation to any of the Services. Neither Streetfast nor any affiliate is liable under or in connection with these Terms for any transportation, delivery or retail service, which are provided solely by Third Party Providers.
Disclaimer
The Streetfast Services are provided “as is” and “as available”. Streetfast and its affiliates disclaim all representations and warranties, express, implied or statutory, not expressly set out in these Terms (including any supplemental terms), including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, and make no representation, warranty or guarantee regarding the reliability, timeliness, quality, suitability or availability of the Services or any services or goods requested through them, or that the Services will be uninterrupted or error-free. Streetfast and its affiliates do not guarantee the quality, suitability, safety or ability of Third Party Providers. You agree that the entire risk arising out of your use of the Services, and any services or goods requested through them, remains solely with you, to the maximum extent permitted by applicable law. Streetfast does not control, manage or direct any Third Party Provider. Third Party Providers are not actual, apparent or ostensible agents or employees of Streetfast. Streetfast does not control, endorse or take responsibility for any User Content or third-party content available on or linked to by the Services, and cannot and does not warrant that the Services or servers are free of viruses or other harmful components.
Liability
Limitation of liability
Streetfast and its affiliates shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage related to, in connection with, or otherwise resulting from any use of the Services, even if Streetfast has been advised of the possibility of such damages. Streetfast shall not be liable for any damages, liability or losses arising out of: (i) your use of or reliance on the Services or your inability to access or use them; or (ii) any transaction or relationship between you and any Third Party Provider, even if Streetfast has been advised of the possibility of such damages. Streetfast shall not be liable for delay or failure in performance resulting from causes beyond its reasonable control. You acknowledge that Captains providing transportation through some request options may offer ride-sharing or peer-to-peer transportation and may not be professionally licensed or permitted. Streetfast shall not be liable for any damages, liability or losses arising out of the lack of, or improper installation or use of, a child restraint system for a passenger for whom one is legally required. Streetfast’s liability for a parcel lost or damaged while in a Captain’s possession is limited to the lesser of its declared value or one hundred Canadian dollars (CAD $100), and claims must be raised within 48 hours of the scheduled delivery. In no event shall Streetfast’s total liability to you in connection with the Services for all damages, losses and causes of action exceed one thousand Canadian dollars (CAD $1,000).
You may use the Services to request and schedule transportation, goods, logistics or delivery services from Third Party Providers, but you agree that Streetfast has no responsibility or liability to you related to any transportation, goods, delivery or logistics services provided to you by Third Party Providers other than as expressly set out in these Terms.
The limitations and disclaimer in this section 5 do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold Streetfast and its affiliates and their officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities and expenses (including reasonable legal fees) arising out of or in connection with: (i) your use of the Services or of services or goods obtained through them; (ii) your breach or violation of these Terms; (iii) Streetfast’s use of your User Content; (iv) your violation of the rights of any third party, including Third Party Providers; or (v) the contents of any parcel you send (“Losses”).
6.Governing law
These Terms are exclusively governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles — except that if you are a resident of Alberta, the laws of Alberta apply to the extent required by Alberta consumer protection law.
7.Dispute resolution
Important — please read this arbitration requirement carefully
Unless prohibited by law, you will have to resolve disputes with Streetfast through arbitration and will not be eligible to obtain money or other relief through a court proceeding. You are free to obtain advice or representation from a lawyer about this requirement.
Arbitration requirement
Unless prohibited by law, all disputes arising out of or relating in any way to (i) these Terms, (ii) the Services, (iii) your access to or use of the Applications, or (iv) advertisements, promotions or oral or written statements related to the Applications or any other Streetfast-branded product will be finally and conclusively resolved by arbitration under the Arbitration Rules (the “ADRIC Rules”) of the ADR Institute of Canada, Inc. (“ADRIC”), except as modified here. The arbitration will be conducted in English or French, as you choose, and may be held anywhere the arbitrator considers appropriate, including remotely by telephone or internet. The ADRIC Rules are available at adric.ca, or you may contact ADRIC at 1-877-475-4353. You will have to pay some fees to arbitrate, as described in the ADRIC Rules; where the law requires, Streetfast will pay filing and arbitrator fees that exceed the cost of filing a claim in your local court.
Informal negotiation first
Before beginning arbitration, the party with the claim must first try in good faith to negotiate a resolution informally with the other party for not less than 30 days and no more than 45 days, unless extended by agreement. Start by contacting in-app support. During the negotiation period any applicable limitation period is tolled (temporarily suspended).
Exceptions
Nothing in this section prevents you from filing a claim with a government agency or regulator. Where you allege a claim of sexual assault or sexual harassment, you may choose to bring that specific claim in court instead of arbitration; Streetfast will honour your choice of forum for that individual claim without waiving the enforceability of any other part of this section 7. Where the consumer protection law of your province gives you a non-waivable right to bring a claim in court or before a consumer tribunal, this section does not remove that right.
Individual basis
To the extent permitted by law, disputes will be arbitrated on an individual basis only, and not as a plaintiff or class member in any purported class, collective or representative proceeding. Where the law of your province does not permit this waiver, it does not apply to you.
Survival
This arbitration requirement survives (i) the termination of these Terms and (ii) the bankruptcy of either party. If any part of it is found invalid or unenforceable, the remaining parts remain in force.
8.Other provisions
Claims of copyright infringement
Claims of copyright infringement should be sent to Streetfast’s designated agent at in-app support or to the postal address below, and must include a description of the copyrighted work, the location of the allegedly infringing material in the Services, your contact information and a statement of good-faith belief.
Notice
Streetfast may give notice by means of a general notice in the Services, by email to the address on your Account, or by written communication to the address on your Account. You may give notice to Streetfast by written communication to:
Streetfast Inc.
Attn: Legal Department
Calgary, Alberta, Canada
General
You may not assign or transfer these Terms in whole or in part without Streetfast’s prior written approval. You approve Streetfast assigning or transferring these Terms in whole or in part, including to (i) a subsidiary or affiliate, (ii) an acquirer of Streetfast’s equity, business or assets, or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, Streetfast or any Third Party Provider as a result of these Terms or your use of the Services.
If any provision of these Terms is held illegal, invalid or unenforceable in whole or in part under any law, that provision or part is deemed not to form part of these Terms, and the legality, validity and enforceability of the remaining provisions are unaffected. In that event the parties will replace the affected provision with one that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect given the contents and purpose of these Terms. These Terms, including any incorporated policies and supplemental terms, constitute the entire agreement and understanding between the parties about their subject matter and replace all prior or contemporaneous agreements or undertakings about that subject matter. Nothing in this clause limits your rights as a consumer that cannot be excluded under applicable law. In these Terms, “including” and “include” mean “including, but not limited to”.
These Terms are drafted in English. Where a translation is provided, the English version prevails to the extent permitted by law. Les parties reconnaissent avoir convenu que les présentes conditions soient rédigées en anglais.
